When last we left Nick Sprayregen, the New York businessman was fighting Columbia University and New York City over Columbia’s proposed takeover of the Manhattanville neighborhood. Columbia has been working closely with the city to invoke eminent domain on the university’s behalf. Sprayregen and another local business have waged an impressive legal battle to keep their land.
As expected, the state’s appellate court sided with Columbia and New York City over the summer. Last week Sprayregen filed a petition for cert to the U.S. Supreme Court.
Reason’s Damon Root explains that this move is the first opportunity for the Court to revisit its 2005 Kelo decision. Kelo turned largely on particularly mushy wording from Justice Kennedy. If Kennedy wants to amend his thoughts on eminent domain, Tuck-It-Away v. New York State will be heard.
